MANDATORY TERMS FOR PRIVACY AND PROXY REGISTRATIONS USING ASCIO’S SERVICES
1.1 If using Ascio’s provider, their details shall be Domain Trustees UK Limited, registered in the United Kingdom with company number 5639299 and whose registered office is at 25 Canada Square, Canary Wharf, London, E14 5LQ (“Privacy Proxy Supplier”).

EXPLANATION OF PRIVACY SERVICES
1.2 Customer shall at all times be listed as the Registered Name Holder of the domain name but all contact details shall be kept confidential.  There shall be no public disclosure of Registered Name Holder’s postal address, telephone, fax or email address in the WHOIS, where details shall be provided by the Privacy Proxy Supplier.  The contact details for the administrative, technical and billing contacts shall be provided by the Privacy Proxy Supplier (or Partner if customized by Partner).

EXPLANATION OF PROXY SERVICES
1.3 Privacy Proxy Supplier shall be listed as the Registered Name Holder of the domain name but all contact details shall be kept confidential.  There shall be no disclosure of Registered Name Holder’s name, postal address, telephone, fax or email address in the WHOIS, where details shall be provided by the Privacy Proxy Supplier.  The contact details for the administrative, technical and billing contacts shall also be provided by the Privacy Proxy Supplier.

RIGHTS ASSOCIATED WITH THE DOMAIN NAMES
1.4 Registered Name Holder shall retain the full benefits of the registration and use of the domain name, including but not limited to, the right to sell, transfer, control, update, change nameservers, cancel, delete and renew the domain name. 
1.5 Registered Name Holder must expressly acknowledge and accept that the domain name is subject to the rules and regulations of ICANN and the applicable domain registry, including all obligations required of Registered Name Holders and any dispute policy adopted by the domain registry including the Uniform Dispute Resolution Policy and Uniform Rapid Suspension. 
1.6 Registered Name Holder must expressly acknowledge and accept that Registered Name Holder is not entitled to use the domain name for any illegal or objectionable activity including gambling, gaming, obscenity and/or for making political statements.  Additionally, the domain name shall not be used for: 
(i) conduct that is unlawful (including breach of any applicable laws, statutes, regulations, standards or codes of conduct whether or not compulsory), harmful, threatening, a nuisance, abusive, harassing, tortious, defamatory, vulgar, obscene, indecent, invasive of another's privacy, hateful, inflammatory, racially, ethnically or otherwise objectionable;
 (ii) the infringement of intellectual property or other rights of any third party;
(iii) distributing viruses, trojan horses, worms, time bombs, cancelbots or any other computer code, files or programs designed to interrupt, damage, destroy or limit the functionality of any software, hardware or data;
(iv) junk mail, spam, chain letters, pyramid schemes or any similar or fraudulent schemes or any inappropriate form of solicitation; or collection of the responses to any such schemes or solicitation;
(v) the forging of headers, manipulation of identifiers or otherwise disguising the origin of any data;
(vi) the provision of false or misleading information;
(vii) denial of service attacks including (without limit) mailbombing, news bombing, trolling, (posting outrageous messages to generate numerous responses), other flooding techniques, deliberate attempts to overload a system, broadcast attacks and any activity designed to cause a computer crash;
(viii) attempting to gain or gaining unauthorized access to, or interfering with or damaging, any third party's computer or data including (without limit) any attempt to breach authentication or security measures or any attempt to probe, scan or test the vulnerability of a computer system;
(ix) unauthorized monitoring or interception of data;
(x) potential or actual interference with or disruption to our computers or services to other customers including excessive use of our server resources or other services;
(xi) violation of acceptable use or similar policies of any internet service providers or connected networks (e.g. sending unsolicited commercial e-mail via our services to the subscribers of any internet service provider that disallows unsolicited commercial e-mail);
(xiii) breach of generally accepted standards of netiquette or norms of the internet community;
(xiv) the provision of any incorrect or incomplete name, address, email address or telephone number or any other false information or otherwise enter information intended to conceal your identity; or
(xv) attempting to reverse engineer, decode or in any way disassemble any software provided in relation to the provision of the service.

DATA ESCROW
1.7 Registered Name Holder’s full contact details will be escrowed to ICANN.  ICANN will however only be able to access this information in limited circumstances.

2 EMAIL AND MAIL FORWARDING
2.1 A unique email address per domain name per contact (registrant, administrative, technical and billing) for management and forwarding purposes will be created.  All emails forwarded shall not be capable of direct reply.
2.2 In respect of postal mail, the Privacy Proxy Supplier shall open any correspondence solely to check the domain which is related to the correspondence.  All postal mail will thereafter be forwarded to Registered Name Holder.
2.3 Privacy Proxy Supplier shall have a dedicated telephone line to deal with telephone inquiries relating to any domain name.  Apart from forwarding information obtained from the telephone call, Privacy Proxy Supplier shall have no other obligation in respect of acting upon or providing any other information from any telephone call.
2.4 Save as to identify the communication to the relevant domain name, there is no service to review, access, assess or analyse such communications.  Registered Name Holder must waive all and any right to make any claim against the Privacy Proxy Supplier, the registrar and any other service provider arising from a failure to receive any email, postal mail and/or telephone message associated with the domain name irrespective of the reason for such failure.

3 PROXY LICENCE
3.1 In providing the Proxy Services, the Privacy Proxy Supplier is considered to be the legal and beneficial owner of all the rights in the domain name for the duration of the Proxy Services in respect of that domain name.  The customer is granted an exclusive, worldwide, irrevocable, royalty free license to use the domain name for any lawful purpose whatsoever. 
3.2 On expiry or termination of the Proxy Services in respect of the domain name, the legal ownership of the domain name will be transferred to customer and they shall immediately become the legal and beneficial owner of the domain name and be listed as the Registered Name Holder in the WHOIS.

4 REGISTERED NAME HOLDER OBLIGATIONS
At the time of placing the order, Registered Name Holder shall be required to provide their name, email and postal addresses, telephone and fax numbers associated with the domain name, together with the same information in respect of the technical, administrative and billing contacts for the domain name. 

5 TERM AND TERMINATION
5.1 Customer shall be permitted at any time to terminate the service with immediate effect at any time.   
5.2 Partner shall be entitled to withdraw the service at any time on 3 (three) months’ written notice.  
5.3 Partner shall be entitled to terminate the service with immediate effect:
(i) When required to do so by law when such action is required, in Partner’s reasonable discretion, to comply with any relevant legal obligation;
(ii) In order to comply with ICANN or the applicable domain registry’s rules, policies or procedures;
(iii) When in receipt of any claim, whether in writing or otherwise, by a third party that the domain name is being used in any way that may lead to a third party commencing legal action against including but not limited to claims for intellectual property rights infringement, breach of any criminal law and/or fraud;
(iv) Where Partner considers that customer is in breach of the matters set out in clause 1.6;
(v) To comply with any court orders, legal judgments, subpoenas or other requests of law enforcement;
(vi) To comply with any dispute resolution policy adopted by ICANN and/or the applicable domain registry;
(vii) when Partner receives a lawful transfer request to transfer the domain name to another domain name registrar; or
(viii) customer fails to comply with the registration agreement.
5.4 Upon termination, Partner shall (i) immediately change the contact details for the domain name to Registered Name Holder (ii) the WHOIS will revert to display Registered Name Holder’s name, postal address, email address, fax and telephone numbers and any other contact information provided on the order and (iii) any service fees paid shall not be refundable under any circumstances.
